DWI & Your Professional License in Texas

DWI & Your Professional License

If you hold a professional license, a DWI arrest is not just a criminal problem. It’s a threat to your career. Nurses, doctors, teachers, pilots, commercial drivers, and other licensed professionals answer to a licensing board in addition to the criminal court, and many of those boards impose their own reporting deadlines and their own discipline, sometimes based on the arrest alone, before you’re ever convicted.

The single most important thing to understand: fighting the criminal case is how you protect your license. A dismissal or reduction doesn’t just keep a DWI off your record. It removes the very finding your board would act on. That’s why licensed professionals should treat a DWI as a career emergency and get an experienced Houston DWI lawyer involved immediately.

How a DWI reaches your licensing board

Reporting obligations. Reporting duties vary board by board. There is no single Texas rule and no universal 30-day clock. Some boards require you to report a conviction, some also require reporting a charge or a deferred adjudication (the accountancy board is the strictest of these, starting a 30-day clock the moment charges are filed), some ask only at application or renewal, and some (the Board of Nursing among them) impose no self-reporting deadline at all. The first thing to pin down is what your board’s own enabling statute and rules require, because where a duty does exist, missing it is often treated as separate misconduct, sometimes worse than the DWI itself.
Automatic notification. Texas DPS criminal-history systems notify some boards on arrest, so your board may learn of the DWI before you tell them.
Board discipline is separate from the court. A board can investigate and sanction based on the underlying conduct even if the criminal case is still pending, or, in some cases, even if it’s dismissed.

The professions we defend

Nurses (Texas Board of Nursing) →: no self-reporting deadline at all, but declaratory orders, TPAPN, and discipline once there is a conviction or deferred adjudication.
Doctors & physicians (Texas Medical Board) →: TXPHP referrals, Board inquiry after a conviction, and mandatory suspension on an initial felony conviction.
Teachers (SBEC / TEA) →: educator investigations and certificate discipline.
Pilots (FAA) →: a written report to the FAA within 60 days of a conviction or a driver license suspension, under 14 C.F.R. § 61.15(e).
Commercial drivers (CDL) →: disqualification rules for CDL holders.
