Tomball sits right at the edge of Harris County. The city is in Harris County, but cross Spring Creek heading toward Magnolia and you’re in Montgomery County, with a different courthouse and a different jury pool. A wreck in town is a Harris County case, filed at the civil courthouse at 201 Caroline in downtown Houston. A wreck a few miles north can belong in Conroe. A Texas injury suit can also be filed where the at-fault driver lived, or where a company defendant has its main Texas office (Civil Practice and Remedies Code § 15.002), so we look at all of it before we pick the courthouse.

SH 249’s frontage road and FM 2920
SH 249 is Tomball’s link to Houston. The free lanes end at Spring Cypress and Boudreaux, and anyone who won’t pay the Tomball Tollway drops onto the frontage road, where freeway speed meets traffic lights and turning cars. The Grand Parkway crosses 249 on the south side of town. FM 2920 runs through the middle of town as Main Street, and FM 2978, Boudreaux Road, Hufsmith-Kohrville and Holderrieth carry traffic from subdivisions that didn’t exist ten years ago on roads built for farm traffic. Rear-end crashes on 249 and left turns across 2920 cause a lot of the injuries we see.
Tomball police write the reports inside the city, and Harris County deputies and constables work most of the unincorporated area around it. North of Spring Creek, it’s Montgomery County’s deputies. Officers usually piece the report together after the fact, but the insurer still treats it as the starting point. We go through the photos, the damage, the witnesses and the cars’ event data recorders to test it, and we get nearby businesses’ video before it’s recorded over.
Where Tomball crash patients go
HCA Houston Healthcare Tomball is a Level III trauma center, and HCA Houston Healthcare Northwest on FM 1960 is a Level II. The most serious injuries go to the Level I trauma centers in the Texas Medical Center. An adjuster looks hard at two things: what the ER wrote down, and if you went back to the doctor when you were told to. A gap in treatment is the first thing he’ll bring up.
What a Tomball claim can include
The 50 percent line. Your recovery goes down by your percentage of fault, and once you’re over 50 percent you get nothing (Civil Practice and Remedies Code §§ 33.001, 33.012). Evidence settles the fault question. Your memory of a crash that took two seconds won’t.
Where the money comes from. Texas only requires $30,000 per injured person and $60,000 per crash (Transportation Code § 601.072). So we look past the other driver’s policy to the vehicle owner’s, the driver’s employer if he was working, a rideshare company’s if one was involved, and your own uninsured and underinsured motorist coverage (Insurance Code § 1952.101). Your personal injury protection pays medical bills and lost wages no matter who caused the wreck (Insurance Code § 1952.155). Texas insurers have to put it in every auto policy unless someone named on the policy turned it down in writing (§ 1952.152). The standard amount is $2,500 per person, and plenty of policies carry more.
Paid, not billed. Your medical damages stop at what was actually paid or is still owed for your care, not the full amount billed (Civil Practice and Remedies Code § 41.0105), so we plan how your treatment gets paid for early.
Pain and lost work. A jury can award lost income, lost earning capacity, pain and what the injury took from your life at home, but it wants to see them in the medical records. So we make sure your doctors write it all down.
Tomball truck and motorcycle cases

Tomball ISD claims and the two-year limit
Suit generally has to be filed within two years of the injury (Civil Practice and Remedies Code § 16.003). A claim against Tomball ISD over a bus crash, or against a city over one of its vehicles, is different: notice is due within six months, and a city charter can set an earlier deadline (§ 101.101).
